well, it depends. if you just take the name, period, then i dunno, its kinda like stealing someone elses' idea. but, if you are a tribute band or something, and play at least one or two of the band's songs, then it is ok. Because I saw this SRV tribute band (dont see that every day) and they called themselves Wall of Denial, which is one of SRV's songs. I thought it helped their image, plus it shows their love for the original source. if you are taking a name because you like the music/idea behind the name, you gotta pay the original source back somehow.
so under the right circumstances, sure its fine. but to just take it and not acknowlede its origin, thats stealing, and its an insult to the original band.

Not as a tribute...but like if The White Stripes took their name from a Eric Clapton song...(not real...hypothetical...)
